Action For Humanity – Legal Disclaimer and Terms of Participation
READ CAREFULLY BEFORE REGISTERING
By registering for any challenge with Action for Humanity (“AFH”), I confirm that I have read, understood, and agree to the following Terms and Conditions. I understand that my participation is subject to full compliance with these terms.
1. Acknowledgement of Risks
• I understand that participation in the challenge involves risks, including physical exertion, injury, illness, loss of property, or other unforeseen hazards.
• I voluntarily assume full responsibility for all risks arising from my participation.
• I agree to follow all reasonable instructions given by AFH staff, partners, or designated challenge leaders.
• I acknowledge that AFH, its officers, employees, agents, contractors, sponsors, and volunteers are not liable for any injury, loss, or damage unless caused by AFH’s negligence or where liability cannot legally be excluded.
2. Medical Fitness and Preparation
• I confirm that I am physically and mentally fit to participate and have undertaken appropriate preparation and training.
• I confirm that I do not have any medical condition, disability, or ongoing treatment that could affect my ability to safely complete the challenge.
• I understand that lack of preparation may increase the risk of injury, and I accept responsibility for any consequences arising from inadequate training.
• I understand that comprehensive travel insurance, covering all activities undertaken during the challenge, is mandatory.
3. Consent to Medical Treatment
• I consent to receive medical treatment considered necessary by qualified medical personnel during the challenge.
• I authorise medical professionals to access relevant medical information and to administer treatment as required in an emergency.
4. Challenge Alteration, Cancellation, or Denial of Entry
• I understand that AFH may delay, modify, or cancel the challenge for reasons including (but not limited to) safety concerns, adverse weather, natural disasters, political instability, or other events beyond AFH’s control.
• I understand that AFH may change the itinerary or dates where necessary.
• AFH reserves the right to refuse, revoke, or terminate my participation if deemed necessary for safety or operational reasons, without liability.
5. Use of Photography, Video, and Media
• I give AFH permission to use photographs, video, audio recordings, or other media taken during the challenge for promotional, reporting, or other legitimate purposes.
• I understand that I will not receive compensation for such use.
6. Waiver and Release of Liability
• I, and anyone acting on my behalf, waive, release, and discharge AFH, its staff, partners, volunteers, medics, representatives, successors, and sponsors from all claims, liabilities, or demands arising from my participation in the challenge.
• I agree not to bring legal action against these parties for any claim waived in this agreement.
• I agree to indemnify and hold harmless AFH from any legal costs, claims, or damages arising as a result of my actions or breach of these terms.
• This waiver does not exclude liability for wilful misconduct or gross negligence.
7. Legal Capacity to Register
• I confirm that I am aged 18 or over and legally able to enter into these terms.
• If I am signing on behalf of a minor or an individual lacking legal capacity, I confirm that I am their parent or legal guardian and accept full responsibility for their compliance.
• I agree to hold AFH harmless from any claims relating to my authority to sign on behalf of another person.
8. Payments and Fundraising Requirements
• Registration Fees: I agree to pay the registration fee according to my selected option (full payment or deposit).
• Deposit Option: If paying by deposit, I understand that the remaining balance is due one month after the deposit date.
• Travel Costs: Unless otherwise stated, I am responsible for my own travel, flights, visas, and transport arrangements.
Fundraising Requirements:
• I must raise the full fundraising amount for the challenge.
• 80% of the fundraising target must be raised no later than one month before the challenge date.
• The remaining 20% must be raised within two months after returning from the challenge.
• I understand that failure to meet the fundraising requirements may result in exclusion from the challenge.
9. Final Acknowledgement
By completing registration, I confirm that:
• I have read and fully understood these Terms and Conditions.
• I accept all obligations, risks, and requirements described.
• My participation is conditional upon adherence to all payment, fundraising, medical, and behavioural standards outlined above.
